Organic Sprouting Seeds : Wholesale Broccoli Seed Output Was Once Patented!

In 1998, Johns Hopkins University released new found information from other study on Broccoli sprouts. It turned out that will Broccoli sprouts had 20-50 occasions more antioxidants than full grown broccoli. That meant that you would have to eat 1 to 3 pounds of broccoli to find the same amount of antioxidants because 1 ounce of broccoli sprouts!

This was big news in the health food world. Overnight broccoli seed became quite difficult if not impossible in the future by. What surprised everyone more than the research itself was what followed shortly then. Within a short period, it became known over the sprouting and health food world that the doctors that had performed the study had formed a corporation because of the name of "Brassica Security Products" and had patented the procedure of sprouting broccoli! With this patent in position, the sale of all organic broccoli seed suitable for sprouting and the production of most broccoli sprouts would have to be licensed by Brassica Security Products.

BPP then started suing people that refused to comply while using patent and many sprout producers stopped growing broccoli sprouts for anxiety about litigation. This also caused many hard feelings between sprouters. Those who complied with all the patent and purchased a license felt a lttle bit cross with those that didn't and felt that they should be compelled to do thus. Those who hadn't given in to the pressure to comply with all the patent felt that your license holders were sell-outs.

BPP sued five sprout growers and one broccoli sprouts seeds supplier in all seasons 2000 and ended upwards teaming up with Environment friendly Giant Fresh Inc. which gave them deep pockets and caused it to be difficult for anyone to help win against them.

Since, patents are presumed valid in the court of law, they can only end up being overcome by convincing facts. In order for the broccoli sprouts to obtain a summary judgment, they would need to offer evidence that was irrefutable. The court would need to rule in support of BPP if there were any questions concerning issues of fact from the grower's case.

In the end, the sprout growers won the truth which was not disputed by BPP. The Judge ruled essentially so it was ridiculous in order to patent a process that was naturally occurring for age range.

Naturally, this came as the relief to sprout growers throughout the nation and perhaps a number of house wives as well who could again begin growing their broccoli seedlings in the kitchen as opposed to the cellar.
